MarAdmin 11/03 Hits the Street: GUIDANCE FOR MANAGING KEY EMPLOYEE RESERVISTS DURING THE CURRENT PARTIAL MOBILIZATION DELAY, DEFERMENT AND EXEMPTION PROCESS
Certain members of the Ready Reserve perform duties in federal as well as non-federal civilian jobs deemed critical under national emergencies. Such individuals are designated as “Key Employees”. Department of Defense Directive (DoDD) 1200.7 established definitions and procedures to screen employees annually to meet potential mobilization requirements under provisions of 10 USC 10149. The DoDD also applies to non-federal businesses. Normally, Key Employee requests must be submitted prior to presidential mobilization. However, due to the unique situation caused by the events of September 11, 2001, the Secretary of Defense issued a Memorandum to all Secretaries of the Military Departments dated October 3, 2001 allowing consideration of Key Employee requests, post mobilization, on a case by case basis.
The following questions should be considered by the business or agency concerned when requesting individual(s) as Key Employees.
· Can the position be filled in a reasonable time after mobilization?
· Does the position require technical or managerial skills that are possessed
uniquely by the incumbent employee?
· Is the position associated directly with defense mobilization?
· Does the position include a mobilization or relocation assignment in an Agency
having emergency functions, as designated by executive order (E.O.) 12656,
Assignment of Emergency Preparedness Responsibilities?
· Is the position directly associated with industrial or manpower mobilization, as
designated in E.O. 12656 and E.O. 12919, National Defense Industrial
Resources Preparedness?
· Are there other factors related to the national defense, health, or safety that will
make the incumbent of the position unavailable for mobilization? Employers must initiate requests to designate individuals as key employees directly to the Under Secretary of Defense for Personnel and Readiness (USD/P&R) for consideration. Reservists must comply with any activation orders received. A Delay, Deferment, or Exemption (DD&E) package requesting a delay to their report date may be submitted for consideration to Marine Forces Reserve (MFR) Command Inspector General to allow adjudication time of their Key Employee request package by DoD. |
