How do Promotion Restrictions work with Marines punished for using Spice?  (Answer Courtesy: Ask MCAAT)

I am respectfully requesting information on prohibited substances as far as promotion restriction.  I am debating on how many months of promotion restriction a member receives if he/she uses the prohibited substances in the enclosures.  I was previously advised that it is considered a drug so it would be 18 months.  My intent is to clarify that information.  Also, Marines have been NJP'd for Article 92, UCMJ vice Article 112a, UCMJ, for the use of Spice.

Please advise.

Answer:  According to the MARADMIN the use of "spice" is punishable as a failure to obey a lawful general order under article 92 of the UCMJ.  Article 134 may also apply.  Article 112a does not apply therefore the 18 month promotion restriction does not apply.

GENTEXT/REMARKS/1.  THE PURPOSE OF THIS MARADMIN IS TO UPDATE THE TWICE PASSED (2P) AND PROMOTION POLICIES FOR RESERVE ENLISTED MARINES AS STATED IN THE REFERENCES.
2.  EFFECTIVE DATE OF RELEASE OF THIS MARADMIN, PARAGRAPH 9109.5A OF REFERENCE (A) WILL ONLY BE APPLIED TO MARINES THAT WERE 2P IN GRADE WHILE A MEMBER OF THE SELECTED MARINE CORPS RESERVE (SMCR) UNITS AND/OR IMA.
3.  ANY PRIOR PASSES IN GRADE IN A DIFFERENT PARTICIPATION CATEGORY OF THE RESERVE COMPONENT WILL NOT COUNT AGAINST PASSES FOR PROMOTION IN THE SMCR CATEGORY.
4.  THE THREE MARINE CORPS RESERVE PARTICIPATION CATEGORIES CONSIDERED FOR PROMOTION PASSES INCLUDE AR, IRR AND SMCR/IMA.  PASSES FOR PROMOTION IN DIFFERENT OCCUPATIONAL FIELDS WITHIN THE SAME COMPETITIVE CATEGORY AND IN GRADE, COUNT TOWARDS A SECOND PASS FOR PROMOTION. EXAMPLES:
    A.  GYSGT PASSED OVER ONCE IN THE IRR JOINS THE SMCR.  WHILE IN THE SMCR, GYSGT IS PASSED OVER FOR PROMOTION.  THIS WOULD BE THE GYSGT'S FIRST PASS IN THE SMCR AND WILL CARRY A 1P FLAG.  UPON ATTAINING A SECOND PASS, GYSGT WILL BE REQUIRED TO TRANSFER TO THE IRR PER REFERENCE (A).
    B.  A MARINE THAT RECEIVES A 1P OR 2P WHILE A MEMBER OF THE IRR OR SMCR, AND IS APPROVED TO AFFILIATE WITH THE AR PROGRAM, WILL REFLECT NO PASSES IN THE AR.  CONSEQUENTLY, AN AR MARINE THAT RECEIVES 1P OR 2P WHILE IN THE AR PROGRAM AND TRANSFERS TO THE IRR OR SMCR, WILL REFLECT NO PASSES IN THE IRR OR SMCR.  THIS IS CONDITIONAL ON THE MARINE NOT HAVING A PREVIOUS PASS IN GRADE FROM THE IRR OR SMCR.
5.  DELETE PARAGRAPH 9109.5C OF REFERENCE (A).
6.  EFFECTIVE DATE OF RELEASE OF THIS MARADMIN, PARAGRAPH 3200.2C(4) OF REFERENCE (B) WILL BE ADDED TO READ AS FOLLOWS: "SMCR AND IMA MARINES AFFILIATED WITHIN 1 YEAR FROM THE CONVENING DATE OF THE SMCR SNCO SELECTION BOARD MUST HAVE AT LEAST 50 POINTS IN THEIR CAREER RETIREMENT CREDIT REPORT (CRCR) FOR THE ANNIVERSARY YEAR COMPLETED PRIOR TO THE CONVENING DATE OF THE SELECTION BOARD TO BE CONSIDERED FOR PROMOTION."
7.  THOSE MARINES IN PARAGRAPH 6 ABOVE WHO DO NOT MEET THE 50 POINT REQUIREMENT WILL NOT BE CONSIDERED FOR PROMOTION BY THE SMCR SELECTION BOARD.  THEREFORE, THOSE MARINES WILL NOT BE CONSIDERED AS BEING PASSED OVER FOR PROMOTION.
8.  CHANGE PARAGRAPH 3200.2D(2) TO READ "BE AN ACTIVE PARTICIPANT IN THE IRR AND HAVE EARNED AT LEAST 50 RESERVE RETIREMENT CREDIT POINTS IN THE ANNIVERSARY YEAR COMPLETED PRIOR TO THE CONVENING OF THE SELECTION BOARD."

GENTEXT/REMARKS/1. PER REF (A), COMPLETION OF THE LEADING MARINES MCI (MCI 0037) IS CURRENTLY THE REQUIREMENT FOR LANCE CORPORALS TO BE CONSIDERED PME COMPLETE. THE COLLEGE OF DISTANCE EDUCATION AND TRAINING (CDET), IN COOPERATION WITH THE ENLISTED PME BRANCH, MARINE CORPS UNIVERSITY (MCU) AND THE LEJEUNE LEADERSHIP INSTITUTE (LLI), HAS DEVELOPED THE LEADING MARINES DISTANCE EDUCATION PROGRAM (EPME3000AA) TO BETTER SUPPORT THE DEVELOPMENT OF THE REQUISITE LEADERSHIP SKILLS FOR LANCE CORPORALS - OUR FUTURE LEADERS. THE LEADING MARINES DEP ON MARINENET WILL REPLACE THE LEADING MARINES MCI.

2. THE NEW LEADING MARINES IMI HAS BEEN DESIGNED TO MEET THE OPERATING FORCES EXPECTATIONS FOR THEIR MARINES PERFORMANCE IN CURRENT AND FUTURE OPERATIONAL ENVIRONMENTS.  ADDITIONALLY, THE COURSE WILL DEVELOP AND ENHANCE OUR MARINES' ABILITIES TO THINK CRITICALLY AND MAKE SOUND, ETHICAL DECISIONS.  THE PROGRAM CONSISTS OF FOUR SUB-COURSES AVAILABLE AS A MARINENET CURRICULUM:

(1)    DEVELOPING LEADERS (EPME3010AA)

(2)    LEADERSHIP TOOLS (EPME3020AA)

(3)    COUNSELLING, COACHING, AND MENTORING (EPME3030AA)

(4)    COMMAND AND MILITARY ORGANIZATION (EPME3040AA) 

3. COMPLETION OF THE NEW LEADING MARINES DEP WILL REQUIRE THE  FOLLOWING ACTIONS:

  A.  ENROLL IN THE LEADING MARINES CURRICULUM ON MARINET (WWW.MARINENET.USMC.MIL).  ENROLLMENT IN THE CURRICULUM WILL AUTOMATICALLY ENROLL THE MARINE IN THE FOUR SUB-COURSES.

  B.  COMPLETE EACH COURSE AND PREPARE FOR END OF COURSE EXAMS. THE STUDENT MAY TAKE THE COURSES IN ANY ORDER, BUT IT IS RECOMMENDED THAT THE STUDENT PROGRESS IN THE ORDER LISTED IN PARAGRAPH 2 ABOVE.

  C.  COMPLETE THE END OF COURSE EXAMS.  UPON COMPLETION OF EACH COURSE, A RANDOMIZED MULTIPLE CHOICE EXAM WILL BE MADE AVAILABLE TO THE STUDENT THROUGH MARINENET.  ALL END OF COURSE EXAMS WILL REQUIRE A PROCTOR.

  D.  SUCCESSFUL COMPLETION OF ALL FOUR COURSES WILL RESULT IN COMPLETION OF THE LEADING MARINES DISTANCE EDUCATION PROGRAM (EPME3000AA).  COURSE ENROLLMENT AND COMPLETION WILL BE AUTOMATICALLY DOCUMENTED IN THE MARINE'S BTR.

4.  PER REFS A AND B, LANCE CORPORALS MUST BE PME COMPLETE FOR GRADE BEFORE THEY CAN BE CONSIDERED FOR PROMOTION.  THE FOLLOWING INFORMATION FOR STUDENTS IS PROVIDED:

  A.  THE NEW LEADING MARINES DEP WILL BE AVAILABLE ON MARINENET NLT 1 JANUARY 2011.  LANCE CORPORALS WHO  COMPLETE THE LEADING MARINES DEP ON MARINENET WILL BE CONSIDERED PME COMPLETE FOR GRADE.

  B.  EFFECTIVE 1 JULY 2011, THE CURRENT LEADING MARINES MCI (MCI 0037) WILL BE DISCONTINUED.  MARINES WHO ARE ENROLLED IN THE LEADING MARINES MCI MUST COMPLETE THE MCI BY 31 DECEMBER 2011 OR THEY WILL BE AUTOMATICALLY DISENROLLED.  LANCE CORPORALS THAT COMPLETE THE LEADING MARINES MCI PRIOR TO 1 JANUARY 2012 WILL BE CONSIDERED PME COMPLETE FOR GRADE.

  C.  STUDENTS MAY VOLUNTARILY DISENROLL FROM THE LEADING MARINES MCI IN ORDER TO ENROLL IN THE LEADING MARINES DEP.    

5.  COMPLETION OF THE LEADING MARINES DEP WILL RESULT IN SELF EDUCATION BONUS POINTS ADDED TO A MARINE'S COMPOSITE SCORE.

6.  ONLY MARINES IN THE GRADE OF LANCE CORPORAL OR ABOVE MAY ENROLL IN THIS COURSE.  WAIVERS FOR ENROLLMENT WILL NOT BE CONSIDERED. THIS ACTION WILL ALLOW FOR A CONTINUOUS REVIEW OF COURSE CONTENT AND ENABLE CDET, THE ENLISTED PME BRANCH, AND LLI TO UPDATE COURSE CONTENT ON A MORE FREQUENT BASIS WHILE PROVIDING A SOLID LINK TO THE COMMAND SPONSORED CORPORALS COURSE.
